SEXUAL MISCONDUCT

All members of Won Institute of Graduate Studies have the right to work and study in an environment free of discrimination, including freedom from sexual harassment and sexual assault. The Won Institute of Graduate Studies strongly disapproves of and forbids sexual harassment, intimidation, and assault in any form, and will not tolerate sexual harassment, intimidation and assault in any form. The intent of this policy is to foster responsible behavior in a working and academic environment free from discrimination. In general, sexual harassment consists of unwelcome sexual advances, requests for sexual favors, and other unwelcome verbal or physical conduct of a sexual nature. The full extent of the legal policy is further defined below as it pertains to various interpersonal relationships. The laws governing sexual misconduct or discrimination based on sex are Title IX of the Education Amendments Act of 1972, the Reauthorized Violence Against Women Act and the Campus SAVE (Sexual Assault Violence Elimination) Act. The Won Institute of Graduate Studies has a Title IX Coordinator to oversee all its efforts at preventing sexual misconduct, responding promptly and equitably to instances of sexual misconduct, and fostering a climate of sexual respect. Sexual Harassment

Sexual harassment of a student by a faculty member or an employee consists of unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when (1) submission to such conduct is made either explicitly or implicitly a factor or condition of the employee’s evaluation of the student or of any decision by the employee concerning the student’s academic, co-curricular, or residential status at the Institute, or (2) such conduct has the purpose or effect of unreasonably interfering with the student’s performance or participation in the academic, co-curricular, or residential programs of the Institute. Complaints of sexual harassment by an employee should be reported to the Title IX coordinator. Sexual harassment of a student by a student is a violation of the Student Code of Conduct and consists of unwanted sexual attention, including unwelcome sexual advances, requests for sexual favors, and other intimidating verbal and physical conduct of a sexual nature. Sexual Harassment in the clinic setting consists of unwarranted touching outside of that necessary for the completion of the clinical activity of either needling, acupressure, moxibustion or other clinical activity. Verbal comments of a sexual nature are not permitted. Sexual harassment of an Institute employee by a student is also a violation of the Student Code of Conduct and consists of unwanted sexual attention, including unwelcome sexual advances, and intimidating verbal and physical conduct of a sexual nature, in particular when such conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile, or offensive working environment. Sexual harassment of an employee by another employee consists of unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when (1) submission to such conduct is made either explicitly or implicitly a term or condition of an individual’s employment, (2) submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual, or (3) such conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile, or offensive working environment. Complaint Process All complaints are first to be reported to the Title IX Coordinator, Frederick Ranallo-HIggins. Complainants are to then follow the Grievance Procedures as set forth in this manual. Cases of sexual harassment by students are handled according to procedures developed by the Academic Dean and the Title IX Coordinator. Where there is probable cause to believe that the Institute’s regulations prohibiting sexual assault have been violated, the Institute will pursue strong disciplinary action through its own channels. Students can be disciplined under the Institute’s Disciplinary Procedure as described below in this Student Manual. This discipline includes the possibility of suspension or expulsion from the Institute. In addition, anyone charged with sexual assault will be reported to the appropriate law enforcement agency and can be prosecuted under a number of Pennsylvania laws that cover such behavior.

Sexual Assault Policy

The Won Institute is committed to an environment conducive to the academic, professional and personal development of students, faculty and staff without the fear of sexual assault. The Institute prohibits and will not tolerate sexual assaults by an employee, student or other individual present on Institute premises. Institute premises are defined as property the Institute owns or has permission to occupy for the purpose of an Institute-sponsored program. Therefore, in accordance with the Pennsylvania State College and University Security Information Act 73 and the federal Higher Education Act (20 U.S.C. 1092), the Won Institute of Graduate Studies has provided procedures to be followed should a sexual assault occur. In addition, the Institute will report sexual assault crime statistics as required by the law. A victim of sexual assault may bring charges through the local police department, the Institute disciplinary system or both. All students, faculty and staff are encouraged to report sexual assault incidents to the local police department (Cheltenham Township Police Department: 215-885-1600). The decision to notify police rests solely with the victim. A sexual assault victim is also encouraged to receive immediate attention by an emergency room physician or gynecologist. Because of the extent of evidence legally required in cases of sexual assault, a prompt and thorough examination is necessary to assess and treat any injuries sustained. This examination will also include obtaining physical specimens, testing for sexually transmitted diseases and establishing the risk of pregnancy. It is imperative any evidence of the assault be preserved. Such evidence may include clothing, pieces of hair, body fluids and objects that may contain fingerprints. The victim of sexual assault will be assisted by the Institute, if the victim so requests, with an escort to medical facilities; by providing short-term, on-campus counseling services; referrals to community counseling agencies; and with the filing of criminal charges. In addition, students may request a change in academic situation after an alleged sexual assault and such changes will be made if they are reasonably available.

Any student, faculty, or staff member who believes they are a victim of sexual assault should contact the police directly at 911 and then notify Title IX Coordinator, Frederick Ranallo-Higgins at the Institute 215-884-8942 or [email protected] Confidentiality will be maintained to the extent requested by the victim. While maintaining the victim’s request for confidentiality, the initial contact person must notify the Cheltenham Township Police Department (215-885-1600) that an alleged sexual assault has occurred.
